These Terms of Service govern your access to and use of clearpeakco.com and any products sold by Seller Vault ("Seller Vault," "we," "us"). By using the site or purchasing a product, you agree to these Terms. If you do not agree, do not use the site or purchase anything.

Products

Seller Vault sells digital products consisting of curated supplier links, setup guides, reference materials, and resale playbooks for various niche categories. Each product is delivered as a digital download to the email address provided at checkout.

We may add, remove, or modify products at our discretion.

License

When you purchase a Seller Vault product, you receive a personal, non-exclusive, non-transferable, and non-sublicensable license to use the product for your own resale business.

You may not:

Redistribute, resell, share, post publicly, or republish the contents of any Seller Vault product, in whole or in part, by any means.
Use the products to build a competing product or service.
Remove or modify any copyright, trademark, or proprietary notices in the products.
Use the products in any way that violates applicable law.

Violations terminate your license immediately, without refund, and may result in legal action, including injunctive relief and damages.

Pricing and Payment

Prices are listed in U.S. dollars and are subject to change without notice. Applicable taxes are calculated at checkout.

Payment is processed through Shopify Payments or our third-party payment processor. By submitting payment, you authorize the charge and confirm that the payment method is yours or that you are authorized to use it.

Refunds

Refund eligibility is governed by our Refund Policy, available at clearpeakco.com/policies/refund-policy. Please review it before purchasing.

Results Disclaimer

Any income, revenue, or sales figures mentioned anywhere on this site, in our products, or in our marketing are illustrative and are not typical. Your actual results will depend on many factors outside our control, including your effort, market conditions, product selection, listing platform, and timing.

Seller Vault makes no guarantee or warranty of any kind that you will earn money, recover the cost of the product, or achieve any specific result. You assume full responsibility for the financial outcome of your resale business.

Supplier Link Disclaimer

The supplier links included in our products are sourced from third-party platforms, primarily 1688.com and similar wholesale marketplaces. Seller Vault does not manufacture, source, fulfill, inspect, or guarantee the quality, availability, pricing, or shipping of any product offered by a supplier.

Suppliers and product listings can change or disappear at any time. We make best efforts to keep links current and may push updates to existing buyers, but we cannot guarantee continued availability of any specific supplier or product.

Your relationship is directly with the supplier. Any dispute, refund request, or quality issue with a product you order from a supplier is between you and that supplier. Seller Vault is not a party to that transaction and is not responsible for it.

Resale Platforms

Many buyers use the products to list goods on third-party platforms such as Depop, Poshmark, eBay, Vinted, or Mercari. Each platform has its own terms of service. You are solely responsible for complying with the terms of any platform on which you sell.

Seller Vault is not affiliated with any of these platforms and is not responsible for account restrictions, suspensions, or removals.

Limitation of Liability

To the maximum extent permitted by law, Seller Vault and its operators, employees, contractors, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, business interruption, account suspensions, customer disputes, or losses arising from supplier issues.

Our total aggregate liability for any claim arising from your use of the site or products is limited to the amount you paid Seller Vault in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater.

Some jurisdictions do not allow the limitation or exclusion of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Seller Vault and its operators, employees, contractors, and affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from your use of the products, your violation of these Terms, or your violation of any law or third-party right.

Account Termination

We may suspend or terminate your access to the site, refuse future purchases, or revoke a license at any time, with or without notice, if we believe you have violated these Terms.

Intellectual Property

All content on the site and inside the products, including text, graphics, layouts, logos, and curated supplier lists, is owned by Seller Vault or its licensors and is protected by U.S. and international intellectual property laws.

Nothing in these Terms grants you any rights other than the license expressly described in Section 2.

Changes to These Terms

We may update these Terms at any time. Material changes will be posted on this page with a revised effective date. Continued use of the site or products after the effective date constitutes acceptance of the updated Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms or your use of the site will be resolved exclusively in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of those courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
